The nature of Rental Determination arises due to conflicts between landlords and tenants during rental review. When Retail Lease Act 2003 (RLA) is applicable to the commercial lease, and when the parties cannot resolve the conflicts on their own, then they must engage certified practising valuers to provide accurate rental assessments to determine the rent in a particular market. This rental assessment can be used in court for mediation or dispute resolution purposes. Alternatively, landlords and tenants can appoint a specialist retail valuer to provide such a specialised rental assessment.
